Abstract:

Under the mechanism of universal criminal jurisdiction, national criminal courts have the responsibility to prosecute and try perpetrators of international crimes and violations within the framework of international humanitarian law, regardless of their nationality or the location of the committed crime. This represents a significant victory for international criminal justice as an effective mechanism for reducing impunity.

However, in the actual application of the principle of universal criminal jurisdiction, several legal obstacles arise, rooted in national criminal law and international custom. These obstacles have limited the scope of the principle, making it necessary to enhance international judicial cooperation by removing legal obstacles, both legislative and judicial.
