The jurists agreed to assign the criminal responsibility to the defendant ,If his felony was against the soul or less than it by acknowledge and deposition , but they differed in assigning responsibility to him because he left with others from a felony, and the offender has not been appointed by admission or testimony. In this case, the jurists differentiate between dispersal for a dead person and the departure from a felony or something less than the soul .In the case of departure from a dead person: Some jurists believe that this departure is a contamination that is justified by its swearing.
And others believe that disunity is not a pollutant, and the owners of this last opinion differed regarding the effect of dispersal, some of them went to waste the blood of the victim, and some of them went to include the owners of the place where the departure took place the blood money by swearing.
A third party considers it necessary securing the blood of the victim with blood money as soon as it is proven that the severance is due to a dead person.
And some jurists went to the obligation of blood money – in what is obligatory for blood money – as soon as the separation after a fight or struggle only.
