Abstract:

 The concept of transitional justice is becoming increasingly important as a system that seeks to address the legacy of human rights violations in various states that have experienced violent conflicts resulting from authoritarian regimes or internal wars on ethnic and sectarian grounds. This concept is based on a wide range of judicial and non-judicial mechanisms that seek accountability, fairness and reparation, and despite the many theoretical problems of the concept as complex, relative and ever-evolving, the problem of the applied model always arises, because the application of transitional justice mechanisms varies in a different way. The results of the application also vary according to many variables associated with the temporal and spatial context of each experiment, and in this context the experiences of South Africa and Rwanda are often referred to as pioneering and internationally renowned experiences in the application of justice at sensitive stages.
